Abstract

The assignment of receivables through cessie, as regulated under Article 613 of the Indonesian Civil Code (KUHPerdata), requires notification, approval, or acknowledgment by the debtor (cessus) for the assignment to produce binding legal effect upon them. Nevertheless, the provision does not specify any temporal limitation or procedural framework governing such notification, thereby creating a normative gap that results in legal uncertainty and divergent interpretations in doctrinal discourse and judicial practice. This ambiguity is evident in the contrasting judicial reasoning found in Decision No. 140/Pdt.G/2022/PN Jkt.Tim. and Decision No. 98/Pdt.G/2022/PN Jkt.Sel., which demonstrate the absence of a uniform legal standard concerning the timing of notification in cessie and consequently heighten the potential for disputes while undermining predictability in the enforcement of receivable assignments. Employing a normative juridical method with statutory and conceptual approaches, this study concludes that the principles of legal certainty, legal protection, and utility demand the establishment of a clear and enforceable temporal requirement for notification to the cessus. Accordingly, this research proposes that notification of cessie be conducted no later than seven (7) days prior to the maturity date of the receivable, thereby providing a minimum normative benchmark capable of ensuring orderly implementation and reducing potential conflicts. It is recommended that this temporal standard be codified through a Government Regulation in order to promote uniformity in judicial application, minimize interpretive disparities, and reinforce legal certainty within the practice of receivable assignment through cessie in Indonesia’s legal system.
