Abstract

The development of artificial intelligence (AI) technology in Indonesia is currently progressing much faster than the process of creating its legal regulations. The absence of specific legislation leaves Indonesia relying solely on general regulations, such as the ITE Law, which views AI as merely a passive tool rather than an intelligent system that can operate autonomously. This study aims to identify and analyze the regulation of AI in Indonesian positive law regarding the use of AI and examine how AI-related regulations should be implemented in the future. The research method used is normative juridical with a comparative and conceptual approach. The results of the study found a legal vacuum in Indonesia when dealing with the risks of autonomous AI, such as in cases of driverless vehicles or data manipulation. Unlike the European Union, this study recommends that Indonesia implement a mixed approach in its new AI Law. The authors propose full liability obligations for producers of high-risk technology, while still providing innovation protection through a "Regulatory Sandbox" and the concept of a "Safe Harbor". This solution is expected to balance public safety without stifling the creativity of national technology developers.
