Abstract

Marriage is an important institution with social, religious, and legal functions. The marital relationship demands honesty and openness of identity between husband and wife. However, in practice, dishonesty regarding sexual orientation is often found, only revealed after the marriage has taken place. Deviation of sexual orientation is not explicitly regulated as a reason for annulment of marriage in either the Marriage Law or the KHI, but the impact is very significant for couples, such as trauma, feelings of deception, and the failure to fulfill biological rights and the purpose of marriage. The case of Purwakarta Religious Court Decision Number 1409/Pdt.G/2024/PA.Pwk shows that the application for annulment of marriage was rejected because the plaintiff was deemed unable to prove the husband's sexual orientation deviation. This condition emphasizes the importance of the role of evidence in civil cases to achieve justice and legal certainty. This research uses a normative juridical method with a statutory approach and a case study of Decision 1409/Pdt.G/2024/PA.Pwk. Data were obtained through primary, secondary, and tertiary legal materials. The results of the study indicate that hidden sexual orientation deviations can be classified as a form of fraud or misconception as referred to in Article 27 paragraph (2) of the Marriage Law and Article 72 paragraph (2) of the KHI, so that it can be a reason for annulment of marriage. However, in the decision, the judge did not explore the evidence optimally, disregarded electronic evidence without presenting an expert, and interpreted the element of fraud narrowly so as not to provide legal certainty for the wife.
