Abstract
In both life and statehood, having a family is a right for every citizen. This inherently involves the process of fertilization through childbirth, which results in a new individual. Informed consent may be rejected or revoked by the patient and/or the patient’s family. Such rejection is documented in an Informed Refusal. Using a normative judicial research method with conceptual and statutory approaches, along with prescriptive analysis techniques, the author examines the legal protection for patients requiring Cesarean sections and the criminal law implications of a family’s refusal of a C-section in abnormal labor if it leads to fatal outcomes. The findings are concluded as follows: Doctors remain obligated to make every effort necessary to save lives and prevent the worsening of a patient’s condition. However, a doctor’s authority becomes limited if the family insists on taking the patient home or refuses necessary medical intervention, despite having received comprehensive explanation and education regarding the potential risks and consequences. If the patient’s family explicitly and repeatedly refuses emergency medical action including emergency Cesarean sections despite extensive educational efforts and their awareness of the risk of death to the patient and/or the infant, such refusal can be deemed to have met the elements of negligence as regulated under the Indonesian Penal Code (KUHP).
