Abstract
The spread of fake news (hoaxes) in cyberspace is increasing and causing legal problems, especially after the implementation of Article 28 paragraph (3) of the ITE Law, which contains the element of “unrest”without a clear explanation. This ambiguity has the potential to lead to multiple interpretations and threaten freedom of expression. Constitutional Court Decision Number 115/PUU- XXI/2024 then confirmed that riots can only be interpreted as a disturbance of public order in physical space, so the limitations and application of this element need to be reviewed. This study aims to: (1) determine the criteria for riots in the context of the spread of hoaxes in cyberspace; and (2) assess the urgency of regulatory reform following Constitutional Court Decision 115/PUU-XXI/2024. The method used is normative legal research through a review of legislation, court decisions, and comparisons with regulations in other countries, such as Singapore's POFMA and Germany's NetzDG. The results of the study show that hoaxes in the digital space can only be criminalized if they are proven to cause actual physical riots, such as public disturbances, mass mobilization, or acts of violence. Not all hoaxes fulfill these elements, so more detailed restrictions are needed to prevent arbitrary law enforcement. Effective handling of hoaxes also requires the role of digital platforms through content moderation mechanisms. In conclusion, regulatory reform is needed to clarify the definition of physical riots and strengthen the system for combating hoaxes in a proportionate manner in order to ensure legal certainty and protect freedom of expression.
