Abstract
Cases of fraudulent recruitment of Indonesian workers to Cambodia represent one of the rapidly growing forms of transnational crime in recent years. The operational modes used by scam agents include posing as licensed recruitment companies, offering fictitious job opportunities, manipulating information on salaries and benefits, and forging placement documents. These practices not only cause economic losses for victims but also create risks of exploitation, forced labor, and even human trafficking. This study aims to analyze two main aspects: (1) the legal relationship between the victims and the scam agents in the context of overseas placement, and (2) the forms of civil liability that may be imposed on scam agents under Indonesian positive law. The research employs a normative juridical method through statutory, conceptual, and case approaches. The findings show that the legal relationship formed between victims and scam agents does not meet the validity requirements of an agreement as regulated in the Indonesian Civil Code and is contrary to the provisions of Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers. Therefore, such a relationship is classified as an unlawful act. In terms of civil liability, scam agents may be held responsible for actions causing harm, negligence, and violations of legal obligations in the placement of migrant workers.
