Abstract

In the Indonesian film and advertising industries, freelance roles such as talent coordinators typically operate under project-based work with verbal employment agreements. Although Indonesian labor law requires fixed-term contracts (PKWT) to be written, PP No. 35/2021 permits verbal agreements, creating ambiguity in employment status. Without documentation, labor safeguards including regulated work hours, overtime limits, compensation, and decent working conditions become unenforceable, increasing worker vulnerability. This study uses a normative–empirical legal approach with purposive sampling. Primary data were collected through in-depth interviews, and secondary data from existing labor regulations. Analysis applies Daniel Little’s causal mechanism framework to explain how the absence of written contracts enables labor rights violations. Results show that 100% of informants did not receive basic labor rights guaranteed by Indonesian labor regulations. The study concludes that contract flexibility lacks substantive protection, highlighting the need for clearer regulatory standards and stronger labor oversight to reduce freelance worker precarity.
