Abstract

Pretrial is a mechanism for monitoring the actions of law enforcement officials, including the determination of suspects, detention, termination of investigation, and termination of prosecution. A pretrial decision that invalidates an investigation or a suspect determination has direct implications for the subsequent legal process. After a case is decided in pretrial, the Public Prosecutor is faced with the dilemma of whether to continue the submission of the case to the District Court, even though the pretrial decision declares the investigation or determination of a suspect invalid. This study aims to analyze the impact of pretrial decisions on the authority of the Public Prosecutor in referring criminal cases to the District Court, as well as to identify unclear regulations in Indonesian criminal procedure law. The method used in this research is normative legal research with a statute approach, case approach, and conceptual approach. Based on the analysis, it was found that although pretrial serves to protect the rights of suspects, pretrial decisions that invalidate investigations or suspect determinations can cause legal uncertainty for the Public Prosecutor. Article 140 of KUHAP does not provide clear guidelines on the actions to be taken by the Public Prosecutor following a pretrial decision that invalidates an investigation. This can slow down the case submission process and potentially harm the parties involved, including victims. This research also found that the lack of legal clarity regarding the submission of criminal cases after a Pretrial Decision causes gaps in the application of criminal procedure law in Indonesia. For this reason, this study recommends changes in the KUHAP regulations to provide legal certainty regarding the authority of the Public Prosecutor in transferring cases to the District Court after a pretrial decision. This recommendation is expected to improve Indonesia's criminal justice system to be more fair and transparent, and reduce legal uncertainty in the law enforcement process.
