Abstract

This study examines the role and legal responsibilities of the Land Deed Official (PPAT) in the issuance of Building Use Right (HGB) certificates that are declared procedurally defective, with a normative review and a case study of the Jakarta Administrative Court Decision No.201/G/2019/PTUN-JKT. The main issues of this research are the role of PPAT in issuing HGB certificates in accordance with applicable laws and regulations, and the form of legal liability when such certificates are declared defective and annulled by the court. This research employs a normative juridical method using statutory, doctrinal, and case approaches, complemented by interviews as supporting data. The findings indicate that PPAT is not only responsible for drafting authentic deeds but also for conducting thorough verification of documents and the legal status of land to ensure the certificate’s validity. PPAT's legal responsibilities include administrative sanctions ranging from warnings to dismissal, civil liability under Article 1365 of the Indonesian Civil Code, and criminal liability if criminal elements are present. The case study of Decision No. 201/G/2019/PTUN-JKT shows that negligence in administrative procedures may lead to certificate annulment and significant legal consequences for PPAT. This research is expected to contribute to regulatory improvements, capacity building for PPAT, and enhanced legal protection in land administration practices.
