Abstract
This study analyzes the parameters of good behavior as a basis for sentence reduction within the correctional system, using a comparative approach between Indonesia and South Korea. In practice, sentence reductions such as remission, assimilation, and parole in Indonesia rely heavily on rigid formal administrative requirements, as regulated in Government Regulation No. 99 of 2012 and Minister of Law and Human Rights Regulation No. 3 of 2018. This approach does not reflect the substantive meaning of good behavior as the result of inmates’ rehabilitation. This research examines how good behavior is applied as a basis for sentence reduction in both countries and how it aligns with sentencing objectives. The study adopts a normative juridical method with statutory and comparative approaches, and qualitative analysis is used to assess the effectiveness of existing regulations. The findings show that South Korea’s legal system is more progressive, utilizing multidisciplinary evaluations by the Parole Review Board. These evaluations consider participation in rehabilitation programs, psychosocial changes, and readiness for social reintegration. Indonesia, on the other hand, emphasizes formal compliance, overlooking substantive behavioral indicators. This creates misalignment with sentencing objectives under Article 51 of Law No. 1 of 2023 concerning the Criminal Code, which emphasizes community protection, crime prevention, and offender rehabilitation. The study concludes that Indonesia needs to reformulate its concept of good behavior, adopting an evaluative approach similar to South Korea’s. This includes revising evaluation parameters, involving professionals, and developing an evidence-based assessment system to achieve more humanistic and reintegrative sentencing outcomes.
