Abstract
This research is grounded in the reality that, although the Fiduciary Security Certificate legally possesses executorial power as stipulated in Article 15 of Law Number 42 of 1999 concerning Fiduciary Security, its implementation has undergone significant changes following the Constitutional Court Decision Number 18/PUU-XVII/2019. The ruling restricts the creditor’s unilateral execution rights and requires court approval, thereby presenting new challenges in fiduciary financing practices, particularly in relation to the effectiveness of creditors’ recovery rights over secured objects. The study aims to analyze the creditor’s executorial rights in the auction of fiduciary collateral resulting from the debtor’s default (wanprestasi), and to evaluate the legal protection available to creditors in exercising such rights. The research adopts a normative juridical approach supported by empirical data, including a case study of the District Court Decision of Pati Number 04/Pdt.G.S/2021/PN Pti and interviews with financing practitioners and legal experts. The findings reveal that, normatively, creditors still retain executorial rights; however, the obligation to proceed through judicial mechanisms has led to delays, increased costs, and a decline in the value of the collateral object, particularly in the case of motor vehicles. The existing legal protections remain largely formal in nature and do not ensure full recovery of losses, especially when auction proceeds fall short of covering the debtor’s outstanding obligations. This study recommends a reformulation of legal policy in fiduciary financing. Such reformulation should include the simplification of the execution process through a more expedient and efficient mechanism, the enhancement of additional collateral systems, and the application of fiduciary insurance and compensation schemes to cover creditor losses resulting from insufficient auction outcomes. Accordingly, legal protection for creditors must not only ensure procedural legitimacy but also guarantee substantive recovery certainty.
