Abstract

In addition to public auction as one form of execution, the sale of collateral objects under private agreement can be carried out based on an agreement between the debtor and creditor. This mechanism is defined as an alternate method of resolving the debtor's obligations in Article 20 paragraphs (2) and (3) of the Collateral Law. The purpose of this study is to determine the challenges that come up while selling collateral items under the table and to come up with ways to make the process more successful. Empirical legal research using a regulatory approach is the methodology employed. In and of itself, collateral is a form of material guarantee that prioritizes some debtors above others. Based on the results of the study, it can be said that the underhanded sales strategy is more successful. The reluctance of debtors to leave properties that are still occupied and the price discrepancy between buyers who demand fair prices in accordance with market conditions and sellers who expect high prices to cover all obligations are two major challenges to the implementation of the sale of secured assets. In order to overcome these obstacles, the problematic loan resolution technique In the banking industry, tactics for resolving troublesome loans are implemented by consulting with debtors to come to an agreement on doing sales under the table in order to address these issues.
