Abstract
This study examines the practice of marriage dispensation applications at the West Jakarta Religious Court following the enactment of Law Number 16 of 2019, which raised the minimum legal age for marriage to 19 years. Despite this legal reform, child marriages continue through dispensation mechanisms. The research aims to analyze the factors that drive such applications and the judicial considerations in granting them. A normative juridical approach was used, combining literature review and interviews with judges and clerks at the West Jakarta Religious Court. The findings indicate that out-of-wedlock pregnancy is the main factor behind dispensation requests, followed by concerns over potential premarital relations and socio-economic pressure. In deciding cases, judges refer to Supreme Court Regulation (PERMA) Number 5 of 2019 on Guidelines for Adjudicating Marriage Dispensation Applications and Law Number 35 of 2014 on Child Protection, prioritizing the best interests of the child. Judicial considerations also include the psychological and physical readiness of the prospective spouses, the urgency of the request, and the long-term impact on the child’s future. These findings suggest that marriage dispensation is not a mere legal exemption, but a cautious legal mechanism aimed at ensuring child protection and justice.
