Abstract

Diploma forgery has emerged as a serious and widespread issue, adversely affecting both individuals directly involved and the broader society. The consequences of such acts are significantly harmful, including the undermining of the integrity of the educational system, the tarnishing of the reputation of educational institutions, and the creation of inequality and injustice in both educational and employment sectors. This phenomenon involves not only individual offenders, but also organization/educational institutions that knowingly issue or facilitate forged diplomas without any legitimate legal basis. This study aims to analyze criminal policy and legal accountability concerning perpetrators of diploma forgery at the primary and secondary education levels, whether committed by individuals or by educational organizations/providers. It also seeks to examine the disparity between the ideal legal norms (das Sollen) and the actual implementation of law (das Sein). The research applies a normative juridical legal method, based on literature review and employing a statutory approach. The findings of this study conclude that the existing legal framework governing the criminal act of document forgery, particularly in relation to diplomas, is available and adequate. However, there exists a significant discrepancy between the legal norms and their enforcement in practice. Law enforcement authorities tend to focus predominantly on individual perpetrators, while educational organizations or institutions that play a central role in facilitating such forgeries are often excluded from criminal liability, despite the existence of clear legal provisions regulating such conduct—particularly within the context of primary and secondary education.
