Abstract
The Indonesian Standard Industrial Classification (KBLI) is a crucial element in supporting the legality and compliance of companies in Indonesia, including KBLI 64200 which regulates the activities of holding companies. This research aims to examine the relevance of KBLI 64200 "Activities of Holding Companies" in regulating share ownership rights by holding companies that already have legal entity status as well as the legal status of share investment by holding companies in subsidiaries that do not include the KBLI in the company deed. This research uses a juridical-normative method complemented by interviews and conceptual and statutory approaches. The results show that the inclusion of KBLI 64200 "Holding Company Activities" in the holding company deed is essential to ensure the legality and legitimacy of business activities. Although the holding company may continue to conduct investment and share sale and purchase transactions, without the inclusion of the appropriate KBLI, the company cannot legally claim or carry out activities as a holding company. The absence of KBLI in the deed may lead to administrative issues, such as inconsistency with the business license that has been obtained, potentially leading to suspension of the business license or other compliance issues. Therefore, it is imperative for holding companies to ensure that the company deed includes the relevant KBLI, to avoid potential legal issues and support the smooth running of legitimate operations in accordance with applicable regulations.
