Abstract
Blood donation is one of the alternative treatments in medicine to cure various diseases caused by blood loss in the body. Blood donation is usually done voluntarily by hospitals. But in its implementation, it is often misused for personal gain so that it is seen as a criminal offense and in law enforcement of such criminal acts, there is a lack of clarity in the regulation in Article 119 of Law Number 17 of 2023 Concerning Health which clearly states that blood is not traded for anything but in the Minister of Health Regulation on Blood Transfusion regulates the criteria for donors, one of which is a paid donor, which means a donor who gives his blood to get payment or other benefits that can meet basic human needs or can be exchanged into cash or can be transferred to another person. So that there is a blurred interpretation of whether blood can be traded or not. The author conducted this research using normative juridical research method by examining some legal literature in the form of legislation in force in Indonesia. The results of the research obtained are the need for further explanation of what the meaning of blood itself is in the applicable laws and regulations and the harmonization between one regulation and another.
