Abstract

The protection of personal data has become a crucial issue amidst the rapid development of information technology, particularly in the online lending sector. This study aims to analyze the legal framework for consumer data protection in Indonesia, given the prevalence of data misuse cases. A notable example is the case of Shinta Widhi Puspito in 2023, where her personal data was misused without consent by an online lending application. This incident highlights significant gaps in the regulation and oversight of data protection in Indonesia.Although Law No. 27 of 2022 on Personal Data Protection (PDP Law) and OJK Regulation No. 77/POJK.01/2016 address various aspects of data protection, their implementation remains weak. This study employs a normative method with a case study and legislative analysis approach. The findings reveal insufficient oversight by relevant authorities and low public awareness of the importance of digital literacy. To address these issues, the establishment of an independent supervisory body, as mandated by the PDP Law, is urgently needed. This must be accompanied by strengthened regulations and rigorous enforcement measures. Additionally, digital service providers should enhance system security by adopting advanced technologies, such as encryption and regular audits. Indonesia can also learn from Singapore, which has implemented stricter data protection regulations under the Personal Data Protection Act (PDPA). These strategic measures are expected to foster a safer and more trustworthy digital ecosystem in Indonesia.
