Abstract

The constitution states that Indonesia is a country that respects freedom of speech by article 28E (3) and that freedom of speech can be applied to any issue including environmental issues. Environmental issues are a global issue that is constantly voiced that even has environmental movements. The issue is increasingly plagued by economic entanglements, so the environment is often pushed aside. Unfortunately, not everyone is free to participate in environmental issues, global witness noted 177 homicides of 2022 environmental defenders worldwide. In Indonesia itself, ward activist far from safe word, Auriga Nusantara listed some 133 cases of 2014-2023 threats against the environmental defense. The data shows the large incidence of strategic participation against public participation (SLAPP) against environmental activists. Although Indonesia has already organized anti-slapp, but execution in criminal cases still has no statute level rules. In the study will discuss criminal law against environmental activists in Indonesia and the comparative rule of anti-slapp in Indonesia with other countries. The study used normatif juridical research methods. The output of this study is a clear Anti-SLAPP arrangement of a legi level that deals with understanding, limitation, remidi and Anti-SLAPP procedures, granting pene authority.
