Abstract

This research focuses on the urgency to examine the influence of local policies, especially customary compensation, on the handling of crime in Wamena, Jayawijaya Regency, and its impact on the effectiveness of criminal law enforcement in Papua. The main aim of this research is to examine the impact of local wisdom, primarily through customary fines, on the handling of criminal acts in Wamena; assess the extent to which local knowledge can increase the effectiveness of criminal law enforcement in Papua; identify and evaluate factors that influence the implementation of local wisdom in criminal law enforcement, with a focus on the context of customary fines in Wamena; as well as providing insight into how these factors influence the effectiveness of criminal law enforcement and providing recommendations for improving the application of local wisdom. This research shows that local knowledge, especially the customary exemplary system, plays an important role in resolving disputes and tensions in the Wamena community. This approach not only allows for a more peaceful resolution but also improves perceptions of justice. The implementation of criminal law enforcement with customary fines is influenced by factors such as customary culture and traditions, customary leadership, socio-economic aspects, collaboration between formal and customary legal institutions, as well as community understanding and awareness. A comprehensive knowledge of the local context and effective collaboration between formal and customary institutions are necessary for the effective implementation of customary fines.
