Abstract
The aim of this research is to analyze the importance of criminalization in the use of animal testing in cosmetics production in Indonesia as well as the appropriate formulation in forming policies regarding animal testing. The problem is why a criminalization policy is needed for producers who carry out animal testing as a product test in the cosmetics production process and how to formulate criminalization regulations for producers who carry out animal testing as a test for cosmetic products in the production process. To be able to answer the problem formulation, the research used is normative juridical research with a statutory approach, a comparative approach and a conceptual approach. The results show that in carrying out animal testing there is a 3R concept (Replacement, Reduction and Refinement). The 3R concept is an ethic that can be used to realize an experiment by looking for possible alternatives. That because many cosmetics companies are competing to create new innovations in order to meet the needs of consumers, not a few of these companies carry out innovation processes carried out by related parties in developing their products and still often use animals for product testing, which in In practice, this has reaped many challenges both from an ethical and scientific perspective. For this reason, criminalization is needed with a legal policy, specifically a criminal law policy with a formulation that regulates starting from the procedures for carrying out animal tasting, what animals can be used as animal tasting, and what the procedures are after carrying out animal testing, and of course whether it is necessary to submit an application to the competent authority before carrying out animal testing, the end result is that the statutory regulations also regulate the sanctions/punishments given to anyone who deliberately violates these statutory regulations.
