Abstract
Indonesia designates the city of Jakarta as its capital city, as stated in the Republic of Indonesia Law Number 10 of 1964 "Regarding the Declaration of the Special Capital Region of Jakarta Raya as the Permanent Capital City of the Republic of Indonesia Under the Name Jakarta." The Medium-Term Development Plan (RPJM) 2020-2024 sets out that the development will take place in the administrative regions of Penajam Paser Utara Regency and Kutai Kartanegara Regency, East Kalimantan. These two regencies were chosen due to their proximity to the developed cities of Balikpapan and Samarinda. Despite the numerous benefits, the Indonesian government has emphasized in national dialogues and mass media that there is strong opposition from some members of the public and experts. They argue that relocating the Indonesian capital would be wasteful, as a substantial amount of money will be spent on building the new capital and implementing all the technology for the smart city concept, while Jakarta will be abandoned. This research constitutes a normative juridical study employing legislative, theoretical, and comparative approaches. It aims to assist in identifying relevant policy elements, decision-making processes, as well as the expected impacts of such a policy. The research findings indicate that relocating the national capital to a new location based on a law as a legal foundation can be considered a public policy, namely the government's response to meeting the needs and interests of the public.
