Abstract

This study aims to determine how the validity of land rights holders on the basis of girik and how legal protection for land rights holders on the basis of girik which have been controlled for years. This research uses normative research with a statutory approach that is prescriptive analytical. Data analysis using qualitative methods. The legal materials used are primary legal materials, secondary legal materials, and tertiary legal materials. The result of this research is that in agrarian law girik is not a proof of ownership of land rights but only as proof of tax payment and is used as a requirement for land registration so that it is invalid to use girik for proof of ownership of land rights. Legal protection for owners or holders of girik is non-existent so that land rights holders must register their land with girik as the basis for issuing land rights certificates.
