Abstract
The scope of national development through employment is stated in Article 28D of the Constitution of the Republic of Indonesia; therefore, the legal provisions governing this mandate are set out in Law No. 13 of 2003 on Labor Affairs and Ministerial Regulations in this regard. This study examines internship contracts as a form of protection for interns from the perspective of labor law in Indonesia. Even though apprenticeships are an important step because they have a very significant positive impact on preparing apprentice for the labor market, this cannot be separated from the challenges of implementing adequate legal protection for them. This study analyzes the legal provisions regarding apprenticeship covenant, in particular in the labor laws and regulations of the Indonesia Minister of Manpower on guidelines for the organization of apprenticeships in the country, and regarding several articles that do not provide certainty and protection so that they have legal implications for non-compliance with these regulations in the implementation of making internship agreements which become a "net" of obstacles in order to create legal certainty and protection through constructive internships. Using a qualitative approach, this study aims to provide a better understanding of the protection of apprentices' rights and recommend steps to improve the regulation of apprenticeships in Indonesia. We hope that the results of this research can contribute to a fairer employment policy and support the development of a high-quality workforce.
