Abstract

The writing of this research aims to determine the use of the mutual legal assistance (mla) method in criminal cases and to determine the optimization of witness examination requests in transnational criminal cases using the mutual legal assistance (MLA) method. The research was carried out in a normative juridical manner using statute approach, conceptual approach, and case approach/ From this research, it is known that (1) Eradication of transnational crime through MLA in Indonesia has been regulated in Law Number 1 of 2006 concerning Mutual Legal Assistance in Criminal Matters which turns out there are still many obstacles in its implementation; (2) Requests for a witness examination using the MLA method in investigation, inquires, and trials in transnational cases are hampered by the absence of an obligation for witnesses to provide information so that the optimization of the mutual legal assistance regulations are very much needed.
