Abstract
This research examines the civil liability of the Food and Drug Administration in cases of acute kidney failure in children in Indonesia. This research aims to analyze the application of the principle of liability based on fault in cases of acute kidney failure in children in Indonesia and analyze the form of civil liability of the Food and Drug Administration in cases of acute kidney failure in children in Indonesia. This research was conducted using normative legal research methods. The results showed that the Food and Drug Administration has fulfilled the elements of unlawful acts stipulated in Article 1365 of the Civil Code. Therefore, the principle of liability based on fault can be applied to the Food and Drug Administration in the case of acute kidney failure in children in Indonesia because the elements in the principle have been fulfilled by the Food and Drug Administration by making a mistake in allowing the circulation of drugs that are harmful to children, so it can be held liable. The form of civil liability in cases of acute kidney failure in children in Indonesia that can be carried out by the Food and Drug Administration is to provide compensation to victims affected by the error. Some forms of damages are nominal damages, compensatory damages, and punitive damages.
