Abstract
This study aims to determine, explain and analyze the urgency of protecting patients' personal data in genomic-based health services. The existing regulatory framework in Law No. 17 of 2023 concerning health and Law No. 27 of 2022 concerning Personal Data Protection has not comprehensively regulated and ensured the protection of patients' personal data. The challenges that arise are data leakage and data misuse that cause losses. In this research, the author uses a normative juridical research approach by examining laws and regulations and literature studies, as well as legal/comparative comparisons with regulations in the European Union and Australia. The results showed that personal data protection has not been implemented in accordance with Law Number 27 of 2022 concerning Personal Data Protection. Comparison with Regulations in the European Union and Australia is related to the absence of an Independent Institution specifically authorized to oversee the implementation of the law so that Indonesia can be considered not meeting the requirements of the adequate level of protection.
