Abstract
Indonesia's civil law system for buying and selling contracts has been regulated in theCivil Code Book II concerning Agreements. This sale and purchase takes place upon the agreement of the parties. The legal aspects of online sales and purchase contracts that they can have legal force are based on freedom of contract as regulated in Article1338 paragraph 1 of the Civil Code concerning freedom of contract. The legalsecurity of online sales contracts in terms of positive legal protection is Law No. 1 of 2008, the Civil Code for electronic transactions, namely articles 40-51, in buying and selling telematics systems that originate from the rights and obligations of bothparties in accordance with Law no. 8 of 1999 contained in Article 4 paragraphs (3) and (6) "the right to receive guidance and consumer education" obligations for business actors must be based on Article 7 concerning consumer protection. In addition, in Indonesia, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions is also enforced. Provisions on legal protection in Indonesia, namely: the Consumer Protection Act, the Law on Information and Electronic Transactions and the Government Regulation on the operation of electronic systems and transactions, the Criminal Code (KUHP), and the Civil Code. (KUHPer). Protection by means of the enactment of Law Number 8 of 1999 concerning Consumer Protection in CHAPTER VIII of the National Consumer Protection Agency, CHAPTER IX of Non-Governmental Consumer Protection Institutions, and CHAPTER X of Dispute Resolution.
