Abstract
The easeness to join investment nowadays means that anyone can finally become an investor or business actor who offers cooperation related to investment. This flexible accessibility also opens up the potential for the emergence of many investment modes circulating, especially in cyberspace. One of them is a mutually beneficial cooperation agreement between investors and business actors which then becomes detrimental due to incidents of unlawful acts, which ultimately drag in other parties such as online loan parties. This research aims to determine the form of legal protection for material losses for victims of illegal investments involving online lenders and to understand the forms of civil liability by perpetrators of illegal investment cases that cause material losses to victims. This research uses a normative juridical research method with a statutory approach and a case approach. The data sources used consist of secondary data, namely primary, secondary and tertiary legal materials. The conclusion of this research is that perpetrators of illegal investment businesses who cause a lot of harm to other people can not only be sentenced to criminal penalties, but can also be sued for compensation due to civil violations of the law. Civil liability arising from the relationship between the victim and the perpetrator is the basis that the perpetrator is the party who must carry out obligations for real losses resulting from his actions. Therefore, special laws are needed that comprehensively discuss illegal investments in Indonesia.
