Abstract
The growth of the Indonesian economy is supported by the increasing interest of the public in investing. This does not rule out the possibility of the emergence of illegal investments that harm the public. To protect victims of illegal investments, the state provides the right to restitution, which is the right of the victim to obtain compensation from the perpetrator of the crime. However, in practice, the right to restitution for victims of illegal investments whose assets are seized by the state is still not optimal. This is due to a number of factors, such as the lack of socialization about restitution to the public, the limited budget of the state to pay restitution, and the complicated process of managing restitution. This study uses normative legal research based on primary legal materials in the form of legislation, official documents related to legal provisions, as well as secondary legal materials in the form of books, articles, legal journals, and the internet. The results of this study discuss the regulations and mechanisms for returning victims' losses through restitution based on the Criminal Code (KUHPidana), the Criminal Procedure Code (KUHPidana), and laws outside the Criminal Procedure Code. In addition, the study also discusses the factors causing the occurrence of illegal investments and the ideal restitution arrangement for victims of illegal investments.
