Abstract

The passage discusses how restructuring a company can enhance the potential for debtors to regain health and perform well. This improvement is expected to have a positive impact on the company's income, leading to an increase over time. Ultimately, the debtor can fulfill their obligations, aligning with the ultimate goal of debt restructuring typically outlined in a peace plan for Suspension of Debt Payment cases. The research focuses on whether corporate restructuring can serve as an alternative to debt restructuring in Suspension of Debt Payment cases and examines the legal consequences of debt restructuring in Suspension of Debt Payment cases. The research methodology involves a normative juridical approach with statutory, conceptual, and comparative approaches, supported by primary and secondary legal sources as well as interviews with experts. The findings indicate that corporate restructuring can indeed be considered an alternative to debt restructuring in Suspension of Debt Payment cases, with legal consequences similar to those of general corporate restructuring.
