Abstract
The purpose of this study is to examine the authority from political parties to candidates for prospective members of DPR who are elected in the genera election through the Open-List Proportional System. This study uses a normative legal method with a statute approach, conceptual approach and study cases. The study shows that political parties still have the authority to terminate the Prospective Members The House Of Representatives who have been directly elected by the people. Political parties can dismiss them if there are clear conditions and evidence. Refers to Article 16 Paragraph (1) of Law Number 2 Year 2011 Concerning Political Parties and Article 426 Paragraph (1) of Law Number 7 Year 2017 Concerning Electoral. In reality, elected the Prospective Members of The DPR who are dismissed without clear reasons legal action is required to obtain clear legal certainty and justice.
