Abstract
The purpose of this study is to find out how judges use the first-to-file registration mechanism to protect pre-existing trademark owners. In the case of registration of the famous Eiger mark which was registered later, on the basis of having similarities in principle in the form of similiarity in sound and speech and arrangement of letters, the holder of the famous Eiger mark is suing the owner of the Eiger mark which was registered earlier (first to file). This legal research uses normative research with a case approach that examines laws and regulations with the cases studied. Trademark owners in the constitutive system (first filing) must submit an application for trademark registration to the Directorate General of Intellectual Property Rights before they can obtain legal protection from trademark law. This study concludes that although the Paris convention and the TRIPS Agreement provide additional protection for well-known marks even though it is not the first registered mark, in the first registration system submitted, the judge's consideration is based on the principle of good faith in protecting the first registering mark holder who submits a request as the constitutive system applies. . The accuracy of the Mark Examiner in granting applications for registration of marks is a mechanism that must be improved in order to provide legal justice for both well-known marks and registered marks.
