Abstract

Evidence is one of the important aspects in the enforcement of Corruption Crimes. The burden of proof is part of the legal system of proof. The law of proof of criminal acts of corruption recognizes a reverse burden of proof system. First, regarding the proof of the crime. However, it is limited to the crime of accepting bribes of gratuity with a value of IDR 10 billion or more [Article 12B (1a)]. Second, regarding the defendant's property which has not been charged (Article 38B). There is not much benefit to prove a crime other than the two objects. To prove a criminal act of corruption other than the one mentioned above, using the usual system is charged to the prosecutor. In practice it can cause problems, namely the conflict between the results of the inverse burden of proof between the first and second objects.
