Abstract
The emergence of illegal online loans is increasingly troubling many people. Therefore, the purpose of writing this Scientific Work is to see the legality and penalties given to illegal online loans when viewed through the Financial Services Authority Regulation number POJK No. 77 of 2016 concerning Information Technology-Based Borrowing and Borrowing Services and Law Number 7 of 2014 on Trade. The research method used in this paper is normative juridical. In its implementation there is a form of threat and fraud as Lex Specialis is regulated in Law number 19 of 2016 amendments to Law Number 11 of 2008 concerning Information and Electronic Technology although it is also regulated in the Criminal Code. Therefore, the role of the Financial Services Authority is very much needed related to the peak of this illegal online loan in terms of prevention so that people are not easily tempted by illegal online loan actors. Although there is not only one punishment related to online lending, but one that is burdensome and is felt to have a deterrent effect for the perpetrators and their corporations can be seen in Law number 7 of 2014 concerning Trade.
