Abstract
The development of technology and information in the financial sector has created a new form of crypto asset known as the Non-Fungible Token (“NFT”). NFT is a line of code or serial number or metadata attached to an asset. NFTs have been used by the public because they have many functions and uses. Starting from a statement of ownership, a statement of authenticity to one of the newest forms of investment that is expected to increase in value over time. The emergence of NFTs also shows that there is a legal vacuum regarding the legality of NFTs, especially as investment assets in Indonesia. The existence of this legal vacuum does not only occur in Indonesia but in various other countries including the United States. This study aims to identify, understand, answer and examine the urgency of legal regulation related to NFTs in Indonesia; and Second, how Indonesian and United States regulations apply to NFTs based on the current applicable laws and regulations. This research is a type of juridical-normative research that is carried out through a statute approach, a conceptual approach and a comparative approach. Based on the findings and analysis, there is an urgency for legal regulation related to NFTs in Indonesia, because NFTs have many benefits and uses for society and state revenue. Then, based on applicable law in Indonesia, NFT cannot be categorized as an investment asset or fulfill the general agreement requirements in the Civil Code. On the other hand, although the United States does not yet have laws and regulations that specifically regulate NFTs, the Commodity Exchange Act of 1936 can classify NFT as a commodity that is subject to United States law and the Commodity Futures Trading Commission
