Abstract
In the community, private deed is more widely used as evidence that an agreement has occurred in various activities. The purpose of this study is to examine the public's understanding of the strength of proof of an underhand deed if it is used as evidence in court. The research used is descriptive qualitative research using purposive sampling. With the data from the questionnaire, it is open to the public who have made and used private deeds aged 21-50 years, tracing legislation and various library materials. Respondents still do not know about the power of private deed if it is used as evidence in court and whether or not legalization and waarmerking are needed in private deed. The ease of making an underhand deed where only handwriting is needed regarding what is agreed upon and signed on stamp duty and a witness is required to witness that an agreement has takenplace, this is what encourages people to choose to use an underhand deed because it is practical, fast, minimal cost and can be done anytime and under any conditions in its manufacture. People are used to making underhand deeds as written evidence in making an agreement because one of the elements of the agreement is a certain form, oral or written. For further research, it is expected to conduct research with a wider number and criteria of respondents. For the public to be able to better understand that every lease agreement, sale and purchase, and others made without the intervention of an authorized public official, it would be better to make it before a notary, which if in the future there is a dispute then the deed has perfect evidence in court.
