Abstract
This study aims to examine the initial serious crimes investigation process in Indonesia which implemented by two state institutions that have a central role, Komnas HAM. Institutions have the authority of investigation which regulated in various regulations such as Act Number 8 Year 1981 concerning Criminal Code, Act Number 31 Year 1999 concerning Human Rights, and Act Number 26 of 2000 concerning Human Rights Tribunal. In terms of ideal concept of structuring the authority to investigate serious human rights crimes, Komnas HAM ought to establish operational standards regulation for the implementation of execute authority or establish a special cooperation team to deal with certain serious human rights crimes involving law enforcement officials through MOU that made by the two institutions to avoid conflicts and misunderstandings between them.
