Abstract
Cannibalism is an act of eating humans, which is not yet regulated in the Indonesian legal system. In 2003, it was discovered that there was a cannibalism case committed by Sumanto who was sentenced for theft because there was no cannibalism rule. This research is a normative juridical research that focuses on deepening positive legal norms using a comparative approach by comparing the laws in several states in the United States regarding cannibalism regulations that have been listed as legal regulations with the legal system in Indonesia. It was found that there were no material for the criminal act of cannibalism in Indonesia, and Article 314 of the Indonesia Criminal Code Bill was considered not to have regulated the criminal act of cannibalism and the existence of a judicial process for cases of cannibalism in Indonesia for which no verdict was imposed on the crime of cannibalism, it is hoped that there will be a material offense in the Indonesia Criminal Code Bill that can coexist with Article 314 of the Indonesia Criminal Code Bill to regulate the criminal act of cannibalism.
