Abstract
Indonesia according to the 1945 Constitution is a country that adheres to the presidential system, where the power of the President as head of government can control the governance. The president in his leadership can form and dissolve Non-structural Agencies) in accordance with the needs of the state at that time. Based on Presidential Regulation No. 112 of 2020 there are 10 institutions that are disbanded. This research uses normative juridical law research method with literature study and statutory approach. This discussion resulted in an analysis underlying the dissolution of Non-structural Agencies caused by the legal basis for the establishment of institutions that have been repealed by the new regulation, the Law does not explicitly mandate the establishment of Non-structural Agencies, Non-structural Agencies are formed through presidential regulations without any mandate from higher regulations, and the mandate for the establishment of Non-structural Agencies has expired, and the duties and functions of Non-structural Agencies that are dissolved should be the duties and functions of ministries / Non-Ministerial Agencies or LPNK). In the mechanism of dissolution of non-structural institutions is carried out through coordination of the Ministry of PANRB, State Administrative Institutions, Ministry of Finance, Ministry of Justice and Human Rights and several related institutions.
