Abstract
At the time of the demonstration on September 25, 2019, there were attacks on medical personnel and ambulances belonging to Indonesian Red Cross which were carried out by Brimob members. International law provides protection to users of the Red Cross symbol who serve in times of international armed conflict, but doesnt apply to situations of non-armed conflict. Starting from regulations related to Red Cross to regulations related to demonstration, there is no one that provides legal protection to medical personnel, ambulances, and injured people. Red Cross Law can’t be used as a solution because it only provides protection for the Red Cross symbol to become the only national symbol and association of Indonesian Red Cross. In the Red Cross Law there are criminal sanctions aimed at those who use the symbol inappropriately, but there is no criminal sanction for those who have attacked the symbol user in accordance with the Red Cross Law. And Finally there was an attack on the ambulance and medical officers belonging to Indonesian Red Cross. This research uses a normative juridical research method with primary legal materials including the 1864 Geneva Convention and its additional protocols, Law No.1 of 2018 concerning Red Cross, as well as other regulations regarding Red Cross and demonstration, as well as secondary legal materials such as research studies, books, scientific journals, and other library materials. The focus of the discussion was limited to attacking ambulances and medical personnel belonging to Indonesian Red Cross in terms of international law and national law related to the use of emblems and demonstration. The results of this study indicate that the Red Cross Law and the Regulations related to demonstration have not been able to provide legal protection to users of the Red Cross symbol so that they become victims while on duty in demonstration. This study also analyzes the factors that cause these events.
