Abstract

Doing business in Indonesia with a franchise concept provides opportunities for entrepreneurs who are just starting their business. Doing business with a franchise concept is desirable because it opens new doors to business opportunities by utilizing existing business modes. Franchising is based on an agreement called a Franchise agreement but there are many legal problems that arise with the franchise agreement. Based on this, this study aims to determine the legal status and legal protection for the parties in the franchise agreement as well as their relationship with HaKI and other laws and organize franchising with partnerships. The normative juridical method is the method used in this study. This method aims to analyze legal material related to the arrangement in franchise agreements and legal protection for parties in Indonesia as well as to see the relationship with HaKI and other legislation and organize franchises with partnerships. This study discusses franchise business agreements and legal protection as stipulated in the Regulation of the Minister of Trade Number 53 / M-DAG / PER / 8/2012 concerning franchising. The content of this research is the legal status and arrangement of the franchise agreement, the legal protection of the parties in the franchise agreement, their relationship with HaKI and other laws and arrangements for franchising with a partnership. The results of this study are expected to serve as a reference for franchisees in Indonesia.
