Abstract

This research was conducted with the fundamental objective of analyzing and assessing the issue of unauthorized use of music in public services in Indonesia. Copyright, as part of intellectual property rights, plays a crucial role in protecting a person's creative work. The use of music in public services or commercial spaces requires royalty payments, as stipulated in Article 12 of Government Regulation No. 56 of 2021 concerning the Management of Song and/or Music Copyright Royalties. The National Institute of Music and/or Music (LMKN) is mandated to collect royalties from parties using songs or music in commercial settings. This research utilizes a normative legal research method, conducted by reviewing applicable laws and regulations applied to a specific legal issue. The documents used are also related to the form of research on written legal norms, namely Law No. 28 of 2014 concerning Copyright and other supporting regulations. The results of this study indicate that unauthorized use of music and/or songs in public services is still widespread. A lack of understanding of legal literacy, along with ineffective and indecisive law enforcement, pose challenges in protecting copyright. Furthermore, technological development, including tools to track copyright infringement and direct oversight by the National Music Agency (LMKN), can also help increase the effectiveness of copyright protection efforts in public services. This research shows that protecting copyright requires a responsive legal system, collaborative platforms, and a public aware of rights and responsibilities. Of course, by involving various parties, including the government, the creative industry, digital service providers, and the community, a just music ecosystem in Indonesia will be achieved and can support sustainable economic growth.
