Abstract
Advancements in artificial intelligence (AI) technology have led to the emergence of deepfake technology, capable of realistically manipulating a person's face, voice, and video. While utilized for creative purposes, this technology is also misused in advertising by depicting public figures as endorsing products without their consent. Such practices risk misleading consumers, as the information presented does not reflect reality and can influence purchasing decisions. This study aims to analyze consumer protection regulations regarding misleading advertisements resulting from the misuse of deepfake technology in Indonesia and China, as well as the legal remedies available to aggrieved consumers. The research employs a normative legal method utilizing statutory, conceptual, and comparative approaches. Primary and secondary legal materials were gathered through literature review and analyzed using a descriptive-qualitative method. The findings indicate that Indonesia lacks specific regulations governing the use of deepfakes in advertising. Legal protection currently relies on Law Number 8 of 1999 concerning Consumer Protection and Law Number 1 of 2024 (the Second Amendment to Law Number 11 of 2008) concerning Electronic Information and Transactions; neither law specifically addresses AI-based content manipulation. In contrast, China has established more comprehensive regulations through the Advertising Law of the People’s Republic of China and the Provisions on the Administration of Deep Synthesis Internet Information Services, which mandate the labeling of synthetic content, user identity verification, service provider liability, and oversight of deep synthesis technology. Therefore, Indonesia needs to enact specific regulations governing the use of deepfakes in advertising to ensure legal certainty and provide more effective consumer protection.
