Abstract
The development of the creative industry and digital technology has significantly increased the use of copyrighted works, including images, illustrations, and sketches, for commercial purposes. While this development encourages innovation, it also increases the potential for copyright infringement through the unauthorized use of copyrighted works. One notable case concerns the use of a sketch/image of the Welcome Monument (Tugu Selamat Datang) in silhouette form on the Sari Ayu Trend Color 2018 (Jakarta Theme) cosmetic products, which was decided by the Supreme Court of the Republic of Indonesia in Decision Number 465 K/Pdt.Sus-HKI/2024. This case raises legal issues regarding the protection of copyright holders whose images are exploited for economic benefits and the implementation of sanctions against violations of economic rights committed by other parties. This research aims to analyze the legal protection afforded to intellectual property rights holders against the commercial use of images and to examine the implementation of sanctions for violations of economic rights under Indonesian law. This study employs a normative juridical research method using a statutory approach and a case approach, through the examination of legislation, legal literature, and Supreme Court Decision Number 465 K/Pdt.Sus-HKI/2024. The findings indicate that sketches or images, as works of visual art, are protected under Law Number 28 of 2014 concerning Copyright, with copyright arising automatically once the work is embodied in a tangible form. The use of an image in silhouette form that retains the essential characteristics of the original work for commercial purposes constitutes an exploitation of the copyright holder's economic rights and therefore requires prior authorization from the copyright owner. In its decision, the Supreme Court held that the unauthorized use of the Welcome Monument silhouette on the Sari Ayu Trend Color 2018 (Jakarta Theme) products constituted an infringement of the copyright holder's economic rights and imposed sanctions in the form of an order to cease production and withdraw the products from circulation. This decision reinforces the importance of copyright protection in ensuring legal certainty, safeguarding the economic rights of creators, and promoting a fair and sustainable creative industry.
