Abstract
This study aims to analyse the efforts of civil society, particularly in the advocacy process surrounding the arrests of Delpedro Marhaen and Muzaffar Salim. The arrests of these activists were prompted by allegations of deliberate incitement. The research employed an in-depth qualitative methodology, whereby the author conducted interviews with competent and relevant parties, the findings of which were subsequently analysed and presented in an analytical format. The findings of this study indicate that these arrests formed part of a legal construct devised by the police to halt the activities of the two individuals. This stands in stark contrast to the police’s duty to ensure the provision of legal protection. Public response was ultimately divided into two camps: those who agreed with the arrests, showed solidarity, and monitored the trial proceedings. Others, however, viewed the two as instigators of incitement; in other words, public opinion was divided or polarised. This clearly poses a threat to Lokataru activists, as arrests, searches, hacking and other threats are increasingly being experienced by these two activists. The impact of these arrests has led to a climate of fear amongst civil society regarding the expression of opinions, whether in digital or physical form.
