Abstract
This study analyzes the legal considerations of the panel of judges in Decision Number 35/Pdt.Sus-Hak Cipta/2021/PN Jakarta Pusat and formulates a construction for a transparent and accountable music royalty payment mechanism by comparing the royalty management systems between Indonesia and Malaysia. The research employs normative legal methods with statutory, case, and comparative approaches. The findings on the first research question reveal that the judges firmly distinguished between performing rights (managed by LMKN) and synchronization rights (inherent to the creator), affirming that royalty payments to LMKN do not absolve users from obtaining direct permission from the creator. The unauthorized use by the defendant was qualified as an unlawful act (Perbuatan Melawan Hukum), reflecting the failure of preventive legal protection due to the absence of transparent information regarding the scope of the license. Regarding the second research question, the study formulates an ideal mechanism (ius constituendum) built upon four pillars: (1) regulatory reform mandating digital micro-logsheets and independent creator verification; (2) the establishment of an independent vertical supervisory body akin to Malaysia's MyIPO, with investigative, audit, and administrative sanctioning powers, implementing the theories of preventive protection and good governance; (3) the transition from blind distribution to hit-based distribution utilizing blockchain technology to realize distributive justice; and (4) the reinforcement of legal education for all stakeholders. The comparison with Malaysia demonstrates that the effectiveness of the system does not rest solely on centralization or decentralization, but rather on compliance based on actual usage data and robust supervision accompanied by concrete sanctions.
