Abstract
The low representation of women in the Aceh Regional House of Representatives (DPRA) has become a significant issue in the policymaking process, as it may result in the inadequate accommodation of women's interests and experiences within legal products. This condition is reflected in the enactment of Aceh Qanun Jinayat Number 6 of 2014, particularly its provisions concerning sexual harassment and rape, which have been criticized for not fully providing protection in favor of female victims. This study aims to analyze the impact of the low representation of women in the Aceh parliament on the formulation of the Qanun Jinayat and to examine how the limited involvement of women in the legislative process contributes to the emergence of provisions that may be discriminatory toward women.This research employs a qualitative approach with a descriptive-exploratory design to gain an in depth understanding of women's representation in the legislative process. Data were collected through semi-structured interviews, document analysis of relevant laws and regulations, records of the Qanun Jinayat deliberation process, reports from related institutions, and supporting academic literature. The analysis is based on Anne Phillips’ Politics of Presence theory, which emphasizes the importance of the direct presence of affected groups in political decision-making processes. The findings indicate that the low level of women's representation, both descriptively and substantively, has affected the extent to which the perspectives and needs of female victims of sexual violence are accommodated within several provisions of the Qanun. The study concludes that the low representation of women is one of the factors contributing to the emergence of gender-insensitive provisions in the Qanun Jinayat that may lead to discrimination against women. Therefore, strengthening women's representation in legislative institutions is essential to achieving a more just and inclusive legal framework.
