Abstract

This research is motivated by the urgency of personal data protection amid rapid digital transformation and the growth of the e-commerce sector in Indonesia. As a state governed by law with a civil law system, Indonesia has a constitutional foundation in the 1945 Constitution of the Republic of Indonesia to protect citizens’ privacy. However, in practice, a paradox persists in which personal data managed as a business commodity by Electronic System Operators (ESOs) is frequently subject to data breaches, placing data subjects in a vulnerable position. This study aims to analyze the legal construction of the civil liability of ESOs for personal data breaches and how law can function as a tool of social engineering to achieve a balance of interests. The research employs a normative juridical method with statutory and conceptual approaches, analyzed using Roscoe Pound’s theory of functional justice. The findings indicate that civil compensation claims, particularly through the construction of tort/unlawful acts, constitute a vital instrument for restoring the rights of data subjects. Nevertheless, significant challenges remain in proving damages. From Roscoe Pound’s perspective, law enforcement in such cases must be capable of minimizing social friction by balancing the economic interests of ESOs and the public’s right to privacy.
