Abstract

This research critically examines the legal pathology and practical juridical deviations in the implementation of Restorative Justice (RJ) within the Indonesian Child Criminal Justice System (SPPA), with the scope of study focused on the Padang District Court Verdict Number 20/Pid.Sus-Anak/2015/PN.Pdg. Philosophically, the SPPA Act is founded upon the Principles of Ultimum Remedium and the Best Interest of the Child, yet its implementation at the adjudication level is frequently distorted toward a retributive paradigm. The findings indicate that the primary deviation lies in the inversion of the sanctions hierarchy (Article 60 of the SPPA Act), where the Judge fails to transform the Ultimum Remedium obligation into a child-centered verdict and instead opts for imprisonment. This pathology is exacerbated by two causal factors: firstly, Judicial Formalism and Practical Deviation, which encompasses the absolute disregard for the recommendations of the BAPAS Community Research Report (Litmas) (Article 24 of the SPPA Act); and secondly, Ethical-Social Pressure, which is actualized through the dominance of the Trial by the Press, compelling the Judge to abandon the scope of RJ to satisfy the narrow demands of public justice. To terminate this cycle of retributive regression, a transition to Transformative Justice (TJ) is recommended, alongside structural reinforcement via the limitation of judicial discretion to impose imprisonment, and an increase in the budgetary allocation and capacity of BAPAS to guarantee the credibility of non-institutional sanctions.
