Abstract
Adoption is a legal act that transfers the rights and responsibilities of child care from biological parents or lawful guardians to adoptive parents through procedures established by statutory regulations. In practice, many adoption cases are still carried out without a court decree, as seen in the Bilqis case and various similar cases, often conducted informally and even involving identity falsification disguised as legal adoption. Adoption conducted without proper legal procedures results in the loss of legal status, identity, inheritance rights, and access to education, health services, and social security for the child, thereby placing them in a vulnerable position at risk of violence, neglect, exploitation, and even trafficking. This study employs a normative juridical method by examining secondary data such as statutory regulations, legal theories, and scholarly opinions. The research focuses on the application of positive legal norms concerning adoption and their relation to the protection of the civil rights of adopted children. The findings indicate that adoption carried out without a court decree is legally invalid, as it contradicts Government Regulation No. 54 of 2007 and Ministerial Regulation No. 110 of 2009. The absence of a court decree eliminates the state's verification function, resulting in the child not being recorded in the legal system, which leads to the loss of fundamental rights and contradicts the principle of the best interests of the child as well as the goals of the SDGs. Therefore, strengthening law enforcement and increasing public awareness are essential to ensuring legal certainty and maximum protection for adopted children.
